General Rules and Information:
Your Acceptance of This Agreement:
By entering the Site you accept and are bound by this Agreement without limitation, qualification or change. You may not use the Site in any way that involves failure to abide by any term or condition of this Agreement.
Changes to This Agreement:
ABS Travel reserves the right to change this Agreement at any time. By continuing to use the Site after a change is made, you accept and are bound by the modified Agreement. Only ABS Travel may alter this Agreement.
Termination of this Agreement:
This Agreement is effective until ABS Travel terminates it. If at any time you determine that you do not accept all the terms and conditions of this Agreement, you must immediately discontinue use of the Site and destroy all materials and copies of materials obtained from the Site.
If ABS Travel determines that you have not complied with any party of this Agreement, it may terminate your access to the Site and any services provided by the Site. Any termination of this Agreement removes your authorization to access or use the Site and requires you to destroy all electronic or other materials and copies of such materials obtained from the Site. However, in the event of termination, you will still be bound by your obligations under this Agreement including the warranties made by you, and by the disclaimers and limitations of liability.
Use of Intellectual Property:
The Site and all of its contents, including but not limited to articles, other text, photographs, images, illustrations, graphics, video material, audio material, and other software (collectively "Intellectual Property") are protected by copyright, trademark and other laws of the United States, as well as international conventions and the laws of other countries. The Intellectual Property is owned or controlled by ABS Travel or the party credited as the provider of Intellectual Property. Additionally, the Site itself is protected by copyright as a collective work and or compilation.
You may not, and agree that you will not, copy, download, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, post, decompile, reverse engineer, disassemble or in any way exploit any of the Intellectual Property, or the Site itself, in whole or part, except as expressly provided in this section of the Agreement.
You may browse the Site and download one copy of occasional materials appearing on the Site that are of personal interest to you for personal, non-commercial use. You must keep intact all copyright, trademark, and other notices contained in this one personal copy. You may not distribute, or otherwise make available to others, this one personal copy. In addition to, and without diminishing any other provision of this Agreement, ABS Travel assumes no responsibility for financial or securities information provided on the Site. You hereby acknowledge that you rely on any financial or securities information received on or through the Site at your own risk.
You warrant that you will not engage in stock manipulation, illegal proxy solicitation, or any other activity contrary to local, state, or federal law, the regulation of the U.S. Securities and Exchange Commission, or any foreign law or regulation.
ABS Travel will not be liable to you or any third party for any consequential, incidental, special or indirect damages, including but not limited to lost profits, trading losses and damages that may result from inconvenience, delay, or loss of the use of information, even if ABS Travel is advised of the possibility of such damages.
Access to and use of the Site is currently available without charge. ABS Travel reserves the right to charge a fee for access to the Site, use of the Site or access to or use of parts of the Site or services available on the Site at any time in the future. Your access to or use of the Site before this time does not entitle you to use of the Site without charge in the future.
ABS Travel reserves the right to charge a fee for all reservations made through its booking engine. Such fees will be posted when making the reservation.
Forum Selection and Litigation:
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law provisions. You agree to submit to the personal jurisdiction of the courts of the State of California, and exclusive venue in the federal and state courts located in and serving Los Angeles County, California as the legal forum for any cause of action arising out of this Agreement.
If a court deems any part of this Agreement invalid, the remaining parts shall remain in full force and effect.
You agree to file any cause of action with respect to this Agreement and your rights and obligations in Pacific Palisades, Los Angeles County, California within one year after the cause of action arises. You agree that a cause of action filed after this date is barred.
ABS Travel is committed to respecting the privacy rights of visitors to any of the ABS Travel web sites. ABS Travel cares about the safety of children and their use of the Internet. Airline Responsibility and Liability
The sole and exclusive responsibility and liability of any ARC and IATA carrier used , shall be in accordance with and as limited by the contract of carriage in the passenger's ticket when issued, the applicable tariffs, and the provisions of the Warsaw Convention, if applicable. Any carrier used shall not be responsible or liable for any act, omission, or occurrence during the time passengers are not on board its airplanes. All tours, services, and transportation (other than air) are furnished by contractors that are independent and that do not act for or on behalf of the carrier, nor are servants of the same, and neither do they have any business relationship, as joint ventures or otherwise.
Further, the carrier shall not be responsible or liable in any way for the accuracy of any representations of the tour operator and its agents on tours or tour services other than those contained in the tour brochures or tour itineraries. Carrier liability for passenger's baggage is clearly stated on the passenger contract included on all tickets or can be found on file for inspection at the offices of the carrier. Liability for checked and unchecked baggage shall in no event exceed the actual loss incurred by the passenger, subject to proof of the amount of the loss.
Overbooking of Flights
Airline flights may be overbooked, and there is a slight chance that a seat will not be available on a flight for which a person has a confirmed reservation. If the flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for a payment of the airline's choosing. If there are not enough volunteers the airline will deny boarding to other persons in accordance with its particular boarding priority. With few exceptions persons denied boarding involuntarily are entitled to compensation.
The complete rules for the payment of compensation, each airline's boarding priorities, and CONDITIONS OF CONTRACT are available at all airport ticket counters and boarding locations.
Some airlines do not apply these consumer protections to travel from some foreign countries, although other consumer protections may be available. Check with the airline.
Some carriers require reconfirmation of your reservations. Contact the transporting air carrier for the applicable requirements.
RESPONSIBILITY: Action Business Services Group, Inc., ABS Travel & Tours, and/or agents and officers and/or suppliers of services pursuant to, or in connection with these itineraries, shall act only as agents for the passenger in making arrangements for hotels, transportation, restaurants or any other service and does not assume any liability whatsoever for any injury , damage, death, loss, accidents, incidents or delay to any person or property due to an act of negligence of or default of any hotel, carrier, restaurant, company or person rendering any of the services included in the tour or by an act of God. Further, no responsibilities are accepted for any damage or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or other causes beyond their personal control., No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any government or authority. The airlines concerned are nnot to be held responsible for any act, omission or event during the time passengers are not on board their planes or conveyances. The passage contract in use by the airlines concerned, when issued, shall constitute the sole contract between the airlines and purchaser of these tours and/or passenger . The right is reserved to withdraw any program in this folder and/or make such changes in the program(s) as may be found desirable for the convenience of the parties and the proper carrying out of tour(s).
Due to the nature of expeditions, tour packages, excursions and/or other services provided; weather, acts of God, government, and/or airline regulations may require changes to be made to the itineraries and/or the cancellation of certain excursions or add-ons. Every attempt will be made to adhere to the itineraries described within the limits of safety and time.
In the event of changes, passengers have no right to any refund or other compensation, for these tours, excursions, accommodations and/or transportations, except were provided by the particular providers of said services. Expedition, excursions, and/or tour fees are based on group participation.
Should you choose not to take part in any activity or make use of services provided, no refund will be made.
Passport and Visas
U.S. citizens traveling outside the U.S. must be in possession of a valid passport. Non-U.S. citizens must check with the appropriate consulate/ immigration office for necessary documents and must obtain them accordingly. A visa may also be required.
Requirements may change so we recommend that you verify any immigration and/or vaccination requirements with the tourists office or consulate before you travel.
It is the passenger(s) responsibility to obtain any and all documents required for travel, including, but not limited to valid passports, exit and/or entry/re-entry visas, and any other documents required by the respective immigration officials of the country/ies you are to visit and/or return to, as well as any required and/or needed vaccinations prior or after your travel.
Cancellations and Refunds
These charges are in addition to any airline, cruise line, hotel, car rental and/or tour operator imposed charges.
